Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of Honmani Japanese (the “Service”), operated by Ryusei Maeda (Honmani!, sole proprietor, Japan)(“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of the Service

Honmani Japanese is a web-based Japanese language learning application focused on Kansai dialect (関西弁). Features include:

  • Kansai-dialect articles with standard Japanese translation
  • AI-generated audio playback
  • Reading comprehension quizzes
  • 6-level difficulty system (pre-N5 to N1)
  • Vocabulary management, bookmarks, progress tracking
  • Offline article access (Premium)

3. Eligibility

You must be at least 13 years old (or 16 in certain EU countries) to use the Service. By registering, you represent that you meet this requirement.

4. Account

4.1 Registration

Provide accurate email and set a password. You may also sign in via Google OAuth.

4.2 Responsibility

You are responsible for maintaining the confidentiality of your account. Notify us immediately of unauthorized access.

4.3 One account per person

Sharing accounts is prohibited. We may suspend accounts with evidence of sharing.

5. Subscription & Payment

5.1 Plans

  • Free: $0: 3 articles per day, all levels, basic features, ad-supported when enabled
  • Premium: $4.99/month at launch (regular price $5.99/month). Yearly ($49.90) and Lifetime ($79.90) plans available.

5.2 14-Day Free Trial

  • First-time Premium subscribers receive a 14-day free trial
  • Credit card required to start
  • Cancel anytime during trial → charged $0
  • If not cancelled before trial ends, automatically charged

5.3 Launch Pricing Lock-In

If you subscribe during the launch promotion, your price is locked for the duration of your subscription. We will not raise prices on existing subscribers. Future price changes apply only to new subscribers.

5.4 Automatic Renewal

Subscriptions renew automatically at the end of each billing period unless cancelled. Cancel anytime via account settings or the Stripe customer portal.

5.5 Refunds

  • Monthly: non-refundable after billing date, except where required by law
  • Yearly / Lifetime: refundable within 14 days (pro-rated if used)
  • EU/UK consumers: 14-day withdrawal right under consumer law

5.6 Taxes

Prices may not include applicable taxes (VAT, consumption tax, sales tax). Taxes added at checkout where required.

5.7 Payment Processor

Payments are processed by Stripe. We do not store your full credit card details.

6. User Conduct: Prohibited Activities

You agree NOT to:

  • Use the Service for illegal purposes
  • Share your account with others
  • Attempt to reverse-engineer, scrape, or copy our content
  • Upload malicious code or attempt to disrupt the Service
  • Impersonate others or misrepresent your affiliation
  • Use automated tools without our written consent
  • Commercially redistribute our content without license

Violations may result in suspension or termination without refund.

7. Intellectual Property

7.1 Our Content

All articles, audio, UI design, logos, and branding are owned by Ryusei Maeda (Honmani!, sole proprietor, Japan) or licensed to us. You receive a limited, personal, non-transferable license to use the Service for your own learning.

7.2 Your Content

Any data you input (vocabulary lists, notes) remains yours. You grant us a license to store and process it to provide the Service.

7.3 Feedback

If you submit feedback or suggestions, we may use them without compensation.

8. Third-Party Services

The Service integrates with third parties (Stripe, Supabase, Google, etc.). Your use of those services is governed by their respective terms. We are not responsible for third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not guarantee:

  • Uninterrupted or error-free operation
  • Accuracy of all Kansai-dialect content (AI-assisted; may contain errors)
  • That the Service meets your specific learning goals
  • Outcomes such as JLPT score improvement

Japanese dialect content is provided for educational purposes. Use in real-world communication is at your own discretion.

10. Limitation of Liability

To the maximum extent permitted by law, Ryusei Maeda (Honmani!, sole proprietor, Japan) is not liable for indirect, incidental, consequential, or punitive damages. Our total aggregate liability shall not exceed the fees you paid in the 12 months preceding the claim, or USD $50, whichever is greater.

This limitation does not apply where prohibited by law (e.g., gross negligence, intentional misconduct).

11. Termination

11.1 By you

Cancel your subscription and delete your account anytime via settings.

11.2 By us

We may suspend or terminate your account for material breach of these Terms. We will notify you and offer refund for unused prepaid time where applicable.

12. Governing Law & Disputes

These Terms are governed by the laws of Japan, without regard to conflict-of-law principles. Any disputes will be submitted to the exclusive jurisdiction of the Tokyo District Court, unless you are a consumer with rights to your local courts under applicable law.

EU/UK consumers retain rights under the EU Consumer ODR platform and local consumer law.

13. Changes to Terms

We may modify these Terms. Material changes will be notified via email or in-app notice at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
